An appeals court in Michigan ruled in favor of the girl with the gun and overturned her conviction for assault with a deadly weapon under that legal theory just last year. They found that by pointing the gun at her assailant, she prevented further violence and affirmed that she was justified in brandishing the weapon even though she was not justified in pulling the trigger at that point. The crux was that they found brandishing is not lethal force (pulling the trigger is) and that since force may be used to prevent an imminent threat of unlawful force from escalating to an imminent threat of death, she was justified in brandishing to back the assailant down.

It still may be appealed by the state to the Michigan Supreme Court, but there's at least one sane set of judges out there.

They set up a BBQ/street carnival in front of his house that afternoon and harassed him for a couple hours beforehand, calling him a racist etc. Apparently he called the fire dept because they were cooking in the street, which of course led to more harassment.
