It’s about justice, not necessary punishment/rehabilitation

Edit: guess that depends on spouse let’s stick with kid

It’s still impossible to prove his BAC, it’s not illegal to drink and drive, it’s illegal to have a BAC > .08 and drive.

Dirty little secret

You don't actually have to prove anything

If you can get a jury to agree he was probably drunk thats enough

You can convict with way less than that
