DA elects not to prosecute because it was a legit mistake. Talk about a frick up of the first order.

Video in link. LINK to article with video

quote:

The Bucks County, Pennsylvania prosecutor has ruled the shooting of an “arrestee” was neither justified nor criminal, but “excused.”

The shooting began with scuffle between a 6’4?, 240-pound non-compliant inmate and officers that took place as the suspect tried to conceal and then flush what looks like a bag of drugs. After shouting “TASER!”, one officer draws and fires his handgun into the gut of the suspect.

the district attorney’s reasoning behind his decision not to charge – or exonerate – the lawman.

However, the letter continues, because the officer believed he was deploying his Taser and not wielding his service firearm, he did not possess the criminal mental state required to be guilty of a crime under state law.

As noted in Weintraub’s letter, Section 304 of the Pennsylvania Crimes Code (Title 18) states that a person has a defense to a criminal charge if he makes a mistake as a matter of fact for which there is a reasonable explanation or excuse.

Brian Riling is probably lucky to have survived the incident. Look for him to cash a substantial settlement check from an upcoming lawsuit he’ll no doubt file against those involved.

That is bs. And it opens up a can of worms. How can you excuse this and not excuse a civilian saying they were reaching for their nerf gun, potato, wallet, etc.

While I back the blue, this individual does not have the mental acuity to know the difference between a taser and firearm in a slightly elevated stress situation.

He is a danger to himself, and others around him in any kind of LEO capacity. He would probably be fine in a white, or blue collar job.

This...if he was so mentally flustered then he shouldn't be a cop. At least not on the streets. Put him behind a desk. That is a massive mistake that could cost someone their life

Can you really not tell a difference between this and your scenario?

And if the cop had better ammo he could have twofered the shot. Hit the perp and his partner who was trying to hold the perp.

I can tell you if that happened to me I (as the cop holding the guy), I would beat the shooters arse when I was able.

Never point gun at something you dont want to kill. Always know what is behind your target.

it is nice to see the cops taking a break from their genocide of black men to shoot a white guy.
