BATON ROUGE - A man was arrested Sunday morning when he barely blew above the legal limit after a head-on accident that killed a driver who ran into his car. According to troopers, 22-year-old Summer McKinnon of Walker was driving along Nicholson Lane around 3 a.m. and crossed the center line of the road, running straight into 35-year-old Chenna Nalabolu's car.

Troopers said McKinnon was not wearing her seatbelt. She was taken to a hospital were she died.

Although Nalabolu did not cause the crash, troopers administered a breathalyzer and he blew .087%. Nalabolu was charged with vehicular homicide.

According to Baton Rouge Clinic, Nalabou is a practicing hospital physician.

That’s some pretty bad luck, but that’s why it’s not worth driving even if you just had a couple beers these days

This seems like a reach.

Need to get his cars black box ASAP because if he wasn't even speeding then the wreck was 100% her fault. Just because there is a presumption he was drunk (via BAC) that doesn't make his actions a proximate cause of her death.

That’s like half a beer from being under the legal limit, AND he didn’t cause the crash

They’ll claim if he wasn’t drunk he could have avoided the wreck.

I have to think the charges will be mitigated once her blood tests are available and the official accident report is completed.

The recent calibration, or lack thereof, of the breathalyzer equipment used by BRPD would also be in question.

They ought to sample McKinnon blood for alcohol. I bet her BAC was at least double was the Dr's was.

I know it was a fatal accident, but blowing a 0.087 is ridiculous to be arrested for.

And his attorney will argue that his being over the limit had nothing to do with the accident, lots of case law on the books, unfortunately it will still create a lot of headaches for him

Never blow, he would have been under by the time they could get a warrant to pull blood.
