Assuming I earned the full check on July 15th, this is nearly $10k in unearned money.

Maybe they really don’t like you and are paying you to stay away and have not have any further contact?

I think that’s what’s going on.

Is one of them possibly the payout for your unused vacation time? Also, the stubs should have a work period on them.

I don't have physical stubs. I opted for digital stubs emailed to me but they stopped coming nearly a year ago. I could email HR and ask for the stub....but I don't want to rock the boat quite yet.

I keep coming back to my work email still being active. I'm use to them being shut off asap after leaving a job. I don't think my boss as told corporate I quit yet, (I worked in a satelite office with 6 staff members. Corporate probably houses 200) which might be my way of keeping the money if my boss parlays it right. I really need to contact him first instead of HR.

Deposit the check. Call them and tell them you’re still getting checks. If they want the money back, ask them for an amount in writing and itemized by dates. Make sure they process the refunds so you don’t get hit in taxes for income you didn’t receive.

You can't guilt trip me into not wanting to give up free money as a result of a former employer's incompetence. Keep trying though.

Legally what could they do ?

Sue you for the money, you tell the judge you spent it and don't have means to pay it back.

Spend 5 days in jail for 100K "sign me up"

I was sued for $10k a couple of years ago. I ignored the papers I was served. Still waiting for that to come bite me in the arse.

As a 30 year practicing labor and employment lawyer, I will just say that there is a lot of bad advice here (and misstatements of the law).

Do you want me to pay you first before you post the good advice?

Um, take it to court and make him pay it back, possibly in addition to damages or fees.

This whole situation seems like a very easy fix (call to company or HR/payroll), but OP seems to be intrigued and wants to steal money from his former company. Just don't be surprised when, you know, they realize the mistake and want the money back (which assumedly they are legally entitled to).

don’t know what’s so hard about making a simple phone call to your HR Dept.

Well because he doesn’t work there and it’s not “his” he dept.

Also HR doesn’t give two shits about you, they only care about the company.
