Almost got in a wreck coming home - not sure who would have been at fault.

Waiting to turn left at a 4 way traffic light. Both my direction and oncoming consist of a single straight or left turn lane and a right turn only lane. No left turn arrow so you have to turn when clear. But across from me is a car also turning left. Since we are both blocking traffic, we both start to turn but as I do, some jagoff on a bike jumps into the right turning lane, zips around the turning car and then straight through the intersection, causing me to slam on the brakes to avoid the hit.

This is a new route home for me and I expect this will happen more so I'd like to know who'd be at fault so I can be extra careful or just not give a frick.

They would be, I believe, assuming they ended up going straight from the right turn lane.

Read the OP. They weren’t turning right. They got in the right turn lane and went straight to avoid the left turner.

If he went straight, through an intersection, from a right turn only lane, who do you think is wrong?

A percentage of fault can be placed on both parties and liability laws vary from state to state. It also depends if both parties tell the same story. If they don’t and you have no witnesses, you have a word vs word scenario where neither party may prove negligence on the other.

Moral of the story, be a defensive driver, as you were, and don’t get in accidents.

Depends on if the other driver admits to going straight from the right turn lane or if any witnesses stick around to validate that he went straight from the right turn lane, otherwise the blame might fall to you.

ETA: Bengal has the same idea but faster fingers

You can get em for like $50 and you cover your arse from this stuff and lying cops and more

Left turning motorist is presumed at fault unless other circumstances warrant overruling the presumption and/or contributory negligence.
