It's miserable to you because you are making non sensical arguments and statements. Please address what I and others have brought up, if a guy is drunk(even super drunk) and has sex with a woman, was he raped? Bc it just seems like that question puts you in a logical bind.

Im not him but if he is inebriated to the point of clearly not comprehending consent then yes he has been raped.
She had the decision making of a child at that point.
She could not describe directions. She ran out into a road in the middle of the dark in front of a car.
Mentally she was a 6 year old at that point.

Some of y’all have no idea what the facts are.
There’s video of her running after the guys to get into their car as they were leaving. Apparently, there’s video from inside the car with her saying she wants to have sex. And then the claim is she got mad and demanded to be let out of the car.
The prosecution is going to say rape because she was too drunk to consent. Part of that evidence to prove this is them arguing she was raped with physical evidence. Of course the defense will now say you can’t know for sure they raped her since she had sex with another guy just before.
Y’all gotta start looking at this in legal terms and take emotion out of it.

Isn't this just speculation at this point? I thought the point of motion was to get the guy under order of the court so facts can come out. They haven't established it occurred yet right?
