I don't think citizen's arrest will fly here because it doesn't appear that they saw him commit a crime...also doesn't appear that he had any stolen stuff on him.

I have some perspective on this. I lived in that area for a couple of years.
I know McMichael, the former police investigator; we had several mutual friends and I spent time around him. The guy is a real dirtbag. He's the kind of cop that gives cops a bad name.
I have little doubt that Aubrey was murdered. I also have little doubt that Martin Luther Cream is just as big a dirtbag as McMichael.

The 911 call transcripts say a lot about the mentality of some of that neighborhood's residents. "Overly cautious" would be a fair assessment... possibly even "inadvertently racist" (assuming there had been a crime wave that was widely-discussed by those living there.
Not even going comment on the appalling nature of the shooting itself going forward... but -
A few things that ran through my mind when trying to understand how this situation came to be...
Were the neighborhood break-ins happening to homes? ...or vehicles? What kind of items were being stolen (cash/jewelry or TVs/electronics etc..)?
Were these burglaries happening at night? ...or during the day?
One caller said it was a regular occurrence. Had he himself witnessed one or more of the burglaries? Had ANYONE witnessed one or more of the burglaries?
Did the victim live or work nearby? Was he a regular jogger? If so - was he the type to take a regular route?
I'll admit that I don't know a whole lot about the background of this case. I do know that if I was a thief - I probably wouldn't repeatedly target the same neighborhood ... on foot.... in the middle of the day.
I am an occasional jogger, however.... Given the choice - I would absolutely decide to run in a quiet tree-filled neighborhood rather than a run-down "hood" (even if I lived in that hood). And I'd prefer either type of neighborhood over a route through a high traffic commercial area. I'm also the curious type - So if I noticed a cool new home being built - I can't say I wouldn't want to go check it out just to see what's what. ESPECIALLY if that house was way out of my price range.
It could be that the guy was casing the joint. It's a reasonable explanation. ... but was it a correct one?
Nothing justifies what happened to the victim.

Jogging or not, you're not getting me to physically fight 2 armed dudes.

Some people do. I dont, but others do. At the gym I go to, a group of guys come right after they get off from work. Construction/labor type jobs. They hope on the treadmill, boots and Jean's and start warming up.

Maybe he saw a truck driving with a baw in the bed of a truck pointing a gun and someone running away and began to follow. When he caught up, this is what he saw.
Either way a citizens arrest doesn’t justify homicide, especially when it was 100% avoidable on their part. those 2 folks are gonna rightfully get sent to the pen. I dont think stopping your vehicle, getting out, and whipping out your shotgun in the middle of the road vs an unarmed jogger is a defensible position regardless of whether or not the victim burglarized anyone.
