"It's time for him to go. And I don't know who he is, but whoever can sit here at a tragic moment like this and laugh and smile when somebody has lost a family member ... in the entire time that Mr. Zirker's sister was speaking that clown, and that's what I am going to call him, a clown, was sitting there smiling and laughing. And you can go, too. Because if you don't know how to act, you can go to jail. So leave. Anybody that can sit there and laugh and smirk -- take her, she's going in the back -- anybody else wanna go? You can go, too. This is a court of law. And these are very serious matters. I understand that you all are very upset because your loved one is going to prison but guess what, she's going to prison for the choices that she made. These people are here grieving, saddened because a senseless act took away their loved one and you're sitting here acting like it's a joke?"
The woman was taken into custody for criminal contempt.
"Your disruptive and disrespectful behavior disrupted today's proceedings and you, ma'am, are going to the Wayne County Jail for 93 days," said Lillard.
gave the woman 93 days. Later reduced to 1 day after the woman apologized.

That's a tad bit excessive. Is 93 the maximum for contempt?

What if the woman had PBA? For those that don't know, PBA is where a person has involuntary bouts of crying, laughing, or anger.

I get this mental image of finger waving and head bobbing.

At first I thought 93 days was a travesty of justice, but then I decided if you're going to laugh during a victim impact statement, I really don't care what happens to you.
I wouldn't have been too upset if it hadn't been reduced.

Yeah, it's a pretty damn hard sentence. However, people seem to have a hard time remembering how to act like decent human beings.

Then she shouldn't be in a damn courtroom. PBA .. just another lame arse excuse for something.

Good for the judge. Don't act like a disrespectful count in courtroom 502!

quote:Depends on the court... but all courts have a max of 1 year, because after that point it becomes a felony and requires a charge/hearing. At least that is my understanding of it.

Wasn't there a journalist that was held in contempt until she hit the 1 year mark because she refused to reveal her sources during a terrorism case?

What a bunch of trash.

They had to be really drawing some attention to themselves for the judge to stop and address them. Obviously these two needed taught a lesson on decency and respect for the severity of the case and people involved.

And to the person who said they should stay out of the courtroom, I hope your closest loved one strokes out tonight and comes down with PBA

That would suck, but I would not take them into a courtroom if they couldn't control themselves
