re: Brandon Miller provided gun for murder

How is that not an accessory to a murder if it's deemed this dude murdered someone?
Going off a response from the NCAA Reddit I just came across:
quote:
Piggybacking this as an attorney in Alabama because these headlines are both intentionally vague and were written to bait people into driving clicks...
The Alabama Code specifically states that intent is necessary for an act to be considered "in furtherance of a crime", therefore making one an accessory or an accomplice.
Both concealed and open carrying are not illegal in Alabama. If they aren't charging Miller there was no intent on his part, and there was some act that broke up the timeline between Miller bringing the gun and Miles handing the gun off. Beyond that, if Miles is charged, he likely did it after the altercation had started, knowing or intending it would be used.
It's a terrible situation all around, and Miller is a fricking idiot for involving himself in any way whatsoever, but that's why he isn't being charged with anything.
and from another article
quote:
Asked by AL.com why Miller was not charged, Tuscaloosa chief deputy D.A. Paula Whitley said, “That’s not a question I can answer. There’s nothing we could charge with him according to the law.”
So if I understand correctly, Brandon was requested by Miles to bring Miles' gun with him, Brandon brought the gun at the request of Miles, Miles took possession of it and gave it to Michael Davis. Michael Davis took it and later that night shot and killed someone. Because there was a timeline gap and couldn't establish any intent, there is nothing they can charge Brandon for.

I also didn't realize it was basically handed off twice, if you will.

I think it would come down to any conversations or actions that can be shown that there was some sort of knowledge of pre-meditation and Brandon knowing and aiding that. Showing and knowing intent.
His car blocked the victim's car in and got shot as a result. Maybe he didn't know for sure at the moment what was gonna happen but it wasn't just a simple handoff then they did some dirt unbeknownst to him.

Yeah, I don't see how they sweep this one under the rug at this point. He is 100% off my personal draft board now.

He's moving up the draft board in my book. He's willing to help a teammate murder soneone. Imagine what he'd do on the court for his boys.

Take him off the draft board
Really?
Yeah i would definitely take him off the board. Anyone that shows that poor of judgement leading to a murder would not be anywhere near my team if i were running it.
I would also have cut Jax the second he was arrested for his stuff also, so maybe the team sees differently.

I mean he's not though. As he hasn't and won't be charged cause apparently, the bar in Alabama is too high based on the evidence of the case.
And part of that is what seems to be missed is that it wasn't Miller's gun. No doubt in my mind Brandon likely knew shite could go down and his people the aggressors was likely, but it was Miles gun being requested brought back to him and Miles was the one that transferred it to the shooter, Davis.
Either way, as good as he looks on the court and would help our shooting woes, I'd pass.

I didn't know that. I legit thought Miller owned a gun, dude asked him to bring it because shite may go down, Miller brought gun and dude was murdered.
But it does change the entire dynamics if the gun wasn't for Miller AND it was for the shooter, and the shooter was asking for Miller to return his gun.
Obviously you can get into questions of why is Miller messing with a gun that isn't his, but if he was just returning the gun to the dude that owned it, now it does sorta make sense as to why he wasn't charged.

I think cooperating normally only lessons the charge, not completely eliminating all charges.

This stuff keeps coming out…
Apparently Miller dropped Miles off at the club first and left, but Miles had left his gun under Millers back seat, then texted him and said he wanted his gun back, but apparently didn’t mention anything about why (there have been reports that said Miles did provide context, but that appears to be incorrect or minimal), and Miller (and Bradley) brought it back. Miller apparently parked his car on the street/alley and one of the guys went and got it out of the back, Miller and Bradley walked off and left at some point (it’s seems Miller left first since Bradley was reportedly with the two being charged earlier), and at some point later the guy charged as the shooter, Davis, was either shot at or started shooting at the other car (that appears to be a disputed fact although Tuscaloosa PD testified there was video evidence that it was Davis) where the girl was killed, and two rounds actually struck Miller’s car.
It appears video evidence backs up that set of events, although there are still plenty of questions, which is the only reason Miller/Bradley weren’t charged.
Seems the combination of the gun being Miles, text messages not indicating the reason Miles wanted his gun back, Miller/Bradley leaving before the shootings, and there being a lot of video of the events all was probably needed for Miller/Bradley to avoid charges as accessories. Plus it seems Miller told the truth up front whereas Miles apparently lied up until he was confronted by the videos.
Typically, the media seems to have made a mess of reporting this stuff in order to try and generate clicks (seems the early ones are the most at risk of being off), so good luck piecing it all together without a lot of digging.

Are you saying Miles lawyer did not say this in court yesterday ?
quote:
According to Miles’ defense attorney Mary Turner, Miles texted Miller at 1:38 a.m. the day of the shooting, saying “I need my joint [gun] a n****r rl jus got a fakin.”

I saw that text too.
Apparently, cause I am not caught up on the latest Alabama urban Gen Z slang, what he basically said is I need my gun back, people are threatening us.
Which would imply motive, but for self-defense. Which is a perfectly justifiable use of a gun in Alabama.
Would be no different than some country BAWS marinating too much on the OT and their funhouse mirror of New Orleans texting their friend to remember to bring back his piece cause they are gonna take I-10 to Mississippi and think it's Mad Max and black people will just be shooting and looting at them everywhere.

I added “or minimal” for that reason.
Early comments seem to have conflated Miles/Davis self defense claim with what was actually texted and prosecutors appear to have determined that “a n****r rl jus got a fakin” was not sufficient to establish scienter of a crime.

I am not well versed on the lingo either.. but I took it as.. "Hey this guy is out here acting like he is a gangster with a gun, but I think he is lying, so bring me my gun so I can show him what a real gangster does."

IMO if Miles had texted your paraphrasing, then Miller would be charged as an accessory right now…Miller is likely very lucky that Miles phrased it the way he did, both in terms of brevity and the high level of slang used.
