It may not be against the code of conduct if he didn't supervise her.

Makes a lot more sense than “he had a few drinks in the office while watching film at 10 pm” haha

Allegedly had sex with a student, based on the Internet rumors.

Those rumors were all around campus as well. According to a family member who attends OU and told me weeks ago. It's a small college town. Everyone is going to know your business. Especially if it's with another student

Ole bastard had to live at the Ohio University Inn while his divorce was finalizing… that should be punishment enough. :Imagine your head football coaching living in a hotel room on campus…

Said undergrad was a 41 year old “student”. Changes the situation a bit.

9-4 in his first year, 45 years old, affair with a 41 year old "student." Don't see a problem

If the only thing is the affair with a student and he's not her supervisor or part of the football program, he's going to win the lawsuit.

Drinking on the job- not a serious offense

How is that not a serious offense. Even having alcohol in the office and not drinking it could be a fireable offense. People have been fired for drinking in the parking lot before

He's denying the affair even happened. He was separated before it started.

Also, the student wasn't in the athletic department and could not have been affected by Smith as alleged by his attorney.

Ohio U better be ready to pay that full salary and potentially pay damages if what they stated publicly isn't true.

41 perhaps changes the "ick" and appropriateness factor, but as long as she's of legal age, it doesn't really matter legally.

If you read the letter from his attorney, there are two women he had a relationship with after allegedly separating. An OU student and the 41 year old.
