I thought when heard the story it was down a slow yellow....not during the fricking cool down lap.
And if you watch a sprint car race, because Sprint cars are high geared and no ignition during cautions they are constantly tapping the gas and jumping forward to keep it running
Who jumps out during the cool down lap?!?

I agree it was very dumb for him to walk out on the track to challenge someone. Extremely dumb and dangerous. Still I think there is some degree of fault on stewart. He clearly hit the throttle

They race bc they love it. NONE of these teams turn a profit. The National tour races for 10K night. These guys spend 400K on the hauler to get their two 80K sprint cars to their track. Not counting the two extra 40K motors they have in the trailer and have to rebuild after 500 laps. If a driver won every night they might break even.

Is there a special race track clause in the vehicular manslaughter law that precludes tony from getting arrested regardless of intent?

I can see how people would be reactionary to first seeing it last night. It doesn't help that it's TS who has a reputation for being a hot head.

This. I have never understood a driver doing that, even under caution or a cool down lap. Far different from confronting a driver in the pits or off the track later.
Terrible situation all around.

This is where the true sense of speculation stems. Maybe Stewart didn’t see Ward. Maybe Stewart tried to avoid Ward and it was too late, again, partly due to the lighting in that area of the track and Ward walking down into the middle of the track dressed in a dark firesuit. As much as it pains me to say this, and I’m not attempting to be an “expert” about this event as it unfolded in any way, but what was Ward doing walking around in the middle of a racetrack with cars coming around still under power? That’d be like someone walking in the middle of a freeway to confront someone who he or she just had a fender-bender with. What did Ward try to accomplish by walking directly in front of Stewart, with the likely intent of shaking his fist or pointing a finger at the three-time Sprint Cup champ for spinning him only seconds earlier?
We can’t ever know.
This isn’t the first time a driver has killed someone – and I use the word “killed” in the sense that, yes, a fatality occurred as an end result, but not due to anything intentional on the driver’s part.
NASCAR Hall of Famer Richard Petty struck and killed – again, I’m using that word in context that a death resulted, but it was not from an overt or intentional act upon Petty’s part – an 8-year-old boy during a drag race on Feb. 28, 1965 in Dallas, Ga.

Even if TS would have slammed on breaks and swerved he would have still hit him. The kid is wearing dark clothes on dimly lite race track

Every track will.make drivers sign waivers that they are not responsible for injuries.Every waiver, every drivers meetings, and often rules posted a staging gate have a dont get on track plastered everywhere.
Growing up on diry racing saw many white trash fights on a race track. Even those r ednecksknew to notgo in front of moving cars
