I am not defending a DUI driver, but he barely hit the guy. There was a minor scratch on his vehicle according to the police and video.

It really depends, but from the video and what the police officer said it really didn't sound like much at all.
The fact he is bringing up emotional issues over what really seems to be a minor fender bender shows he's just trying to get paid. Again, good on him I guess.

He’s an idiot. As said he didn’t look completely hammered, I’m not sure why a guy like him wouldn’t have just called a lawyer and had them do all the talking to prevent some of this.
Jay should have just shut up and went with it. Simply say he hadn’t drunk anything and lawyer up.
