I used Turbo Tax. It asked if I paid child care. All I did was fill in the blanks on the app. Had I known it would AFFECT her I wouldn’t have done it. If anyone wants to actually help me out instead of berating me I’d appreciate it. Does she need to file a 1040 and show the $2500? Is it another form for self employment? Any other options besides her filing?

Eh... it's a babysitting service. Generally you can only work when your customer requests you to work. If you run a babysitting service, you can't show up when you want to babysit my kids.

Now you certainly can decline the opportunity and therefore set your own hours and terms.

If you only have one customer, it looks more like an employee than a babysitter who has several different clients.

Independent contractors usually have more than one client.

It is not the end of the world. OP could file a return for her, pay the taxes, and help her open a Roth IRA.

This is exactly what I was thinking. It would more than make up for the niece's troubles and would get her off to a great start to investing.

But he didn’t 1099 her right? He simply tried to get a tax benefit (writing off childcare) and the byproduct affected his niece.

I’m just curious though how did she get roped in? You named her? I guess I didn’t realize you had to specify who did the babysitting.

How would he have claimed childcare credits without affecting his niece?


As others have said - at this point your niece is obligated to file a return now. It’s not that she’d owe the income tax, but you brought the governments eyes upon her lol

Bro. Give her another 2500 cash and tell her you have her covered for anymore. Why would you claim that on your taxes? you should pay for her college for being dumb AF.

EDIT - Sorry. just noticed you are a bama fan. So you probably could amend your return and claim you sister as your wife and the niece as dependent child of yours. huge refund incoming then.

I'm not a tax dude and don't have kids, so I dont know if it'd be called a 1099 or not. I'm just piling on the op bc it looks like the cool thing to do.

You do have to file Form 2441, which requires you to list the provider's info.

How about not fricking up anymore and do what you should have done in the first place if you were not sure and seek advice from a cpa, tax lawyer, etc instead of a message board...

It’s been a long time since I had small kids, but I thought you to have daycare outside of your home in order to qualify for a deduction. If she provided daycare at your home, I thought you couldn’t take a deduction. I can’t believe the OP would claim that $2,500 as a deduction and not realize that he made it taxable income for his niece.

Wouldn’t surprise me to see the newly staffed up IRS actually audit her books because of this. They have been very aggressive lately.
