This is not about O... As others have said, this is a lawyer doing everything possible to tie O to this case. Quotes reported last year by "witnesses" are suddenly being changed in new media reports. This shite will not hold up in court. They are playing to the media naming O and TAF in some grand scheme as to coerce a settlement from the bad optics.

Do you think O was some mastermind assistant coach that held all the power over TAF and LSU compliance?

Civil RICO is very difficult to prove. There are lots of elements that must be proven, and it is much more complicated than a traditional fraud case. But the attraction is treble damages and attorneys fees for the plaintiff, if successful at trial. Some plaintiffs’ attorneys use RICO allegations to up the ante to push for a higher settlement, but the strategy can backfire because it involves accusing the defendant of crimes, and some defendants would rather fight such accusations than settle.

In a civil conspiracy, they need prove by a preponderance of the evidence that two more people combined in a manner so as to damage the plaintiff. "Unlawful" or criminal conduct is not required. In a RICO conspiracy an intent to defraud is usually required, which is criminal.

Yes it is.

Unlawful or tortious. You can’t sue someone for “conspiring” to do something legal.

If my buddy and I decide We’re going to work together to take down your company by offering competitive services at a better price that’s not a conspiracy. It’s a business plan.

seems like the plantiffs lawyer/lawyers is trying to do or find any way whatsoever to include Orgeron in this lawsuit. and they are doing that so they can solidify their RICO claim by seperating Coach O and "TAF". my guess would be so that they can say that TAF was the "enterprise" or "organization" in said RICO. without being able to seperate O and TAF then the whole suit would most likely get thrown out. You cant name a defendant in a RICO suit without also being able to name an enterprise. this will actually be an extremely hard suit to win for the plantiff and there is a TON they will have to prove. i just dont see that happening. A RICO allegation is extremely hard to prove/win and is very, very detailed and all of those details have to be proven not just the broad allegation. Even in a civil suit. lets not forget that even John Gotti not only beat a RICO charge, he beat the very people who made the RICO statue specifically for gangsters like him. it just shows how detail orientated and hard to prove they are...
LSU and ED O may end up beating this, if not for the sole purpose of them being innocent; but also because the plantiffs lawyers are risking a pretty bold and almost dumb move by including the RICO allegations.....
