Our company attorney said he expects the TRO to be granted but another hearing will be had regarding a permanent injunction and appeal, etc. and said that is when it will be thrown out. There is precedence to grant TRO's even with no merit to the case. Also stated that it is very likely parts of the lawsuit get thrown out today but still expects the TRO to be granted against the people of LSU but there is still a good chance it gets thrown out if the judge remains completely impartial but didn't feel confident based upon the precedence to grant TROs even with poor merit to the case.

I think the point is that they COULD
The bylaws allow for this to happen with no real rules being broken. Just need some salty school presidents

The state court TRO prevents the SEC from enforcing its rules.

Yeah I don’t know if other schools realize the slippery slope that expulsion unlocks as an enforcement option if it has no guard rails tied to any sort of procedural protections or independent fact finder.
It’s like attempting to prosecute politicians once they leave office and the other side gets power. It’s hard to put that genie back in the bottle once you uncork it.

They don't need evidence. The only argument is whether a group of school can collude to stifle competition. If the SEC votes LSU out, LSU will file suit claiming antitrust violations. Kennedy, on the judiciary committee, will call for hearings. The Protect College Sports Act would be in jeopardy.
