I'm pretty sure it was posted yesterday that the SEC admitted in their filing that the claim came from an anonymous source in a CBS Sports article from August.
I'd imagine if the SEC had anything more concrete than that, they would have added it.

If there are no safeguards for malicious intent against a member, yes.
If they tell the SEC they can go after whoever they want, for whatever they way, this will devolve even further.
