Malpractice suits

Malpractice claims are difficult. They must be presented to a Medical Review Panel (made up of medical doctors) whose job is to review the medical records and make a decision on whether the Malpractice claim is valid. If the decision by the MRP goes against the injured party, then and only then can a lawsuit be filed in the court system.

So a lawsuit being filed means that GB has exhausted his original Malpractice claim.

Most doctors don't rule against their own unless there is no doubt that something was done wrong... i.e. they amputated the patient's wrong leg.

It’s ironic that a lot of people here will comment that healthcare costs are out of control in the US and broken.

And simultaneously think 39 days after vertigo to find a tumor is too long.

I wish we could demonstrate to them how much their premiums would go up if every single person with vertigo got an immediate MRI.

...or how long it would take to see a neurologist if we had government run healthcare.

A lot of people are dumb.

No it doesn't. The malpractice claim is only against the practitioner. Other parties can be sued in tort beyond the malpractice claim. LSU isn't being sued for med mal

I believe two of the people named in the lawsuit and described as team doctors are licensed physicians, but I understand what you are saying. I wonder if part of the "misdiagnosis" claim is him saying he told the doctors that he wanted to get checked out, and they told him not to worry about it as it was just vertigo. I'm not saying that could happen, but I can see how things like that could get thrown into a lawsuit.

LSU team doctors are not the athletes PCP.
All this.
Amazed at all the anti coach and team medic comments. How has society evolved to not owning a problem or misfortune?
If the vertigo lasted a week without obvious cause, I would've seen my PCP, not take advice from ankle tapers when my team position and lucrative career are threatened by that affliction.

not saying that didn't happen, but the article says Yahoo has a copy of the 13 page lawsuit (not just reports, but a copy of the actual suit).
if something like that was mentioned in the suit, it seems like they would have put that in the article.

It is just a tough situation all around. Lawsuits have to blame someone. I

quote:

The lawsuit notes that the university paid for Brooks' medical care.

I just wish people would not automatically blame people in that building, I doubt any of them are qualified to diagnose his condition accurately.

I have gotten vertigo when going to a seat in East Upper Deck. Should I have seen a neuro? No.

I have gotten positional vertigo while lying down.

I have had dizzy spells getting up too fast from a horizontal position.

None of this vertigo was a neurological problem.

Diagnoses of many medical problems are delayed because there are symptoms that can be attributed to numerous illnesses. They start with the most obvious and work their way through the possibilities.

39 days for a diagnosis of brain tumor is good.

I had a friend whose cancer metasticized into the brain. She was normal and then she was not. There was a marked difference in her speech, handwriting and behavior not long before diagnosis.

GB was fortunate to be diagnosed as quickly as he was.

I find it interesting that the WBRZ article notes this and Dellinger/Yahoo didn’t:

The lawsuit notes that the university paid for Brooks' medical care.

No shite. GB's lawyers likely filed a single lawsuit against all potential defendants. That means the medical review panel is done.

No it’s not, at all. Vertigo is fairly common and usually a result of an inner ear issue. You don’t get vertigo and immediately go to a brain scan.

To be frank, if he were not a football player who had access to the medical teams that he did, it may not have been diagnosed at all.

I have been dealing with vertigo for over 1.5 yrs now and have been to numerous doctors and none have given a diagnosis and none have checked me for a brain tumor. I do suspect that is because my bloodwork did not indicate that as a possibility. Mine is not inner ear derived but is from neck pain presumably due to arthritis but they wont even tell me that.

So to say that oooh he had vertigo he must have a brain tumor is rediculous...

Yea, he got his diagnosis way faster than 99 percent of the population would've.

Rather than causing delay, LSU sped up his diagnosis and treatment tremendously.
