Building a House - Neighbor wont let me use his lot - What could happen?

I'm currently building in Lafeyette area. There is an empty lot beside me. The owner of it has been a headache since the beginning. We haven't damaged his lot or used his lot in anyway but continues to bitch and moan. Keeps coming out with measuring tape and everything to double verify everything is up to code (which it is).
Anyways, we've come to the point where we need to drive a piece of equipment on about 5 ft of his property for it to get to the backyard.
He is refusing to give permission. What's the worst that can happen if we go ahead and do it anyways?
Bitch to cops about trespassing? Might get a ticket? Try to sue me for damages (which I'd gladly pay if there even are any)?

This right here. I’m thinking I’d consider offering it to him for break even… Maybe explain to him how you are a responsible adult that really wants to be a good neighbor to someone but in light of his doucheyness you have reconsidered where you want to live. Maybe offer him an asswhoopen? I’m sure you can work something out. What about offering him $350 to travel across the property while explaining you’d rather his Royal doucheyness get the money than the courts.

I just edited it. The guy actually is trying to sell it and is currently building elsewhere

If he has measuring everything, sounds like he`s been trespassing on your property.
Could you be the problem?
Are you or your contractors leaving trash and debris everywhere that ends up in his yard?
Either way, you will be making things worse, if you don`t figure out another way.
Could you have not done what you wanted to do on your own property before this point ?

So he doesn't want ruts in it when people look at it? Cant really blame him.
Contractors are great at tearing shite up and dumping trash everywhere.

He can sue you but would basically be limited to damages that he would have to prove. I would do it and plead ignorance. Make damn sure it's not damaged (or repaired well if it is)

You should show extreme interest in purchasing this lot from him.
Play the negotiating game with him - even have him draw up a purchase agreement.
Drag it out as long as possible.
Then suddenly change your mind once you've done with using that 5 feet of his property.

Do I appear mad? I'm simply stating what are the consequences if I drive a piece of equipment to the back of the lot.

About 200 ft. My house is being built all the way to the 5ft setback of his lot. I need to drive a bulldozer to the back of my lot. For it to get there it will need to drive over the corner of his lot and could possible kill some weeds/grass (this is not a well manicured lot, its overgrown). There will be no actual damage besides flattening some grass which will grow back in 2 weeks..
At the beginning of the build there was an agreement that this would be ok with the owner of said lot. During the building phase he has constantly questioned the 5ft setback (and been incorrect everytime) and he has become angry and no longer wants to allow the use of his lot to reach the back of my lot

Send him this picture and tell him you are going to report him for trespassing.
And also tell him that if he keeps harassing you, that you are recording all interactions and you will be talking with your attorney about bringing a harassment lawsuit.
I sold my empty lot to a builder several years ago. Dude was a complete shite head.
He called me one day bitching about my chicken coop and how it was hurting his ability to sell his house. Told him, that wasn't my issue and basically didn't care. Bugged me about it some more and then I found out that he report me to the county for environmental damage (because of the chickens of which i have 6 at that time).
He called me bitching about the coop again and I basically said what I told you do do and that I was currently sitting with my attorney (I actually was as he's one of my best friends), and that my attorney was looking forward to speaking with him.
Never said anything else.

Curious as if you do it anyway what can he do? A trespassing ticket? Or will he get an attorney to sue you for ruts?
