Can SCOTUS step in without it running through lower courts first? Can that proactively go after this being they already ruled on the exact same thing?

Normally I would agree.

The CDC blatantly thumbing their nose at a prior ruling? I think that gets fast tracked.

My understanding is that they have already ruled on this exact situation before, which means it doesn’t need to be relitigated.

Unless there is a substantial difference between this moratorium and the last one, this shouldn’t take long.

Yeah, I mean the federal government could come in but not sure where they have jurisdiction even.

Unless they send an order to me directly there is no way in the world I would stop.

I mean... how fricking stupid can he be? He agreed the CDC overstepped its authority by issuing the moratorium but then said "hey, since it's almost up it can stay." That's an in-fricking-sane precedent. How does someone on the Court even take that into consideration?

And then he tosses out some wide-eyed naivete with their needing "clear and specific congressional authorization (via new legislation)" to extend it. They are extending it without any new legislation.

Now it's got to go back to court all over again.

If I were a landlord I would just proceed, assuming a State court isn't stopping the process. Let them sue and seek an injunction, they would first have to kick out to federal court.

Than all you have is incomplete notice without the ability of having an administrative hearing.

This would actually all have to go back to the administrative level i.e. agency hearing.

It’s ridiculous, owed a nice chunk of change at the moment on stuff I could’ve sold before the start of this and made $ and can still do the same if it ever ends but at the moment it’s pathetic, glad they are paid for…
