Well, if I were a landlord I would have just proceed with the eviction, assuming the State court is not stopping the process.

In theory, the federal government could come in for some type of injunction, but they don't even have an administrative record of the specific events. They haven't provided proper notice nor have provided an opportunity for a hearing.

Than I would see what happens.

They changed it some, limiting it to a criteria based on case counts. It's enough to make it go through the system on it's own.

We'll just ignore the fact that the criteria accounts for 90% of the population.

If landlords spend 1 penny on maintaining their properties, they're fools. Who does this end up hurting most? Those living in rental properties.

Court systems are severely backed up. I hear there is a wait list of 9 months in my state for anyone wishing to contest a custody order. Even criminal trials are severely delayed.

So there would be a lot of renters living somewhere for free anyway.

Why can't landlords just evict anyways. It would go to court and the judges have a clear precedent. So they would just rule for the eviction.

Outside of liberal blue states.

If the landlord has nothing to fear by proceeding than I would proceed. I'm not sure whether these State court judges are holding stuff up (some states have holds on as well).

Assuming the State court is allowing things to proceed, I would just do it... and wait for the feds to sue or intervene. (Just my quick take, maybe an eviction attorney has more insight as to what the State courts are doing)

In general, I think state and muni courts have generally been closed for months.

Even when they do allow people to file, the docket is full for a significant period of time.

Problem with that is that when there are no more laws on the government, the little people get extremely upset.

Well, there are plenty of suits on this. Just saw a $26b suit for a "taking" in federal claims. This is going to be complicated though, and its hard to predict one single winner nation wide. These cases sometimes drag out for decades, the NC Map Act suits involving a "taking" is more or less still going on - which started over 30 years ago.... damages are expect to be around $1b.

Like I said, these are complicated matters, the federal and state governments could still be on the hook. This one would potentially be worth $1t plus???

In Florida, NW Florida at least, the tenant must show at court hearing and prove a difference in income before and after moratorium due to COVID

Being the lazy worthless deadbeats they are and scared of court and some even running from law, they usually don’t show at court and certainly not with the required income loss justification

We’re 2 for 2 on evicting deadbeats not paying and they have to leave immediately after court hearing too

Both homes were in terrible disrepair though requiring $10,000 and $15,000 respectively to get back in rent condition

FYI

Military bases are close and we try to rent to them but can’t discriminate
