OT Lawyer advice needed—Stolen motorcycle recovery, bike secured NEW UPDATE p.35

A few years ago I had my motorcycle stolen from my college apartment. Filed a police report and hadn’t heard a thing in years. Today I get a call from a BRPD detective saying they found it in Mississippi. It was dropped off for repairs and then never picked up. They went to go sell it and discovered it was mine.

The detective tells me that I should handle it with the wrecker shop, so I call them and tell them I’m willing for them to sell it and we can split the profit minus the repairs so I don’t have to deal with it and everybody wins. The lady comes back and says “no can do” and that if I want the bike back, I need to pay the $2,000 bill. She pretty much said “yeah it’s not worth your time, we’ll handle it. Sorry.” At that point, I asked to see the invoice and she said that if I decide to keep it, that it would be nice to compensate her for her time. WTF. Doing more digging, I see she doesn’t work for the wrecker company and is an account manager for an insurance agency. I understand them not footing the bill, but I gave them a good way out and they declined it. I’m going to call the police department in the jurisdiction in Mississippi tomorrow but figured I would let the brilliant minds of the OT also offer advice.

Did you file a claim and get paid for the stolen motorcycle from the insurance company?

in La. they would have a mechanic's lien, but i don't know whether your ownership plus it being stolen trumps their lien.

Sounds as though this “repair “ shop be in on the whole thing.

Not exactly the same but had a truck basically firebombed and taken into possession of local sheriff department salvage yard.

Evidence. They kept it well after insurance settled up. Wanted to charge me $4k for “storage “ fees lol. SMH

Do you still have the police report with the Vin #? Call the police dept in that city, tell them someone has your stolen bike and they are now trying to extort you for the return of it. Regardless of this being a mechanic shop or a snowball stand, they're in possession of stolen property. The burden is on them to defend their self when the cops show up. They can hire an attorney and sue the guy who dropped it off and go through that entire debacle, or just give your bike back.

It would look real bad if they end up getting a black eye for being a chop shop. When you escalate the issue and the local law shows up I'm sure ole gal will have a change of heart.

A friend’s car was stolen once. Police found it, called a wrecker company, then called him. He had to get it from the wrecker company and pay the tow fee.

I would assume this is the same here. You may pay for a wrecker tow fee. But if the company did any work on it, then they have to sue the owner for that money. Just my logical guess.

I bet she went to do a mechanics lien and was notified that vin is stolen
The detective is lazy her loss is with the person that brought in the bike not you and she can’t lien it because it’s stolen
Like a pawn shop when they have stolen merchandise they eat the loss
I could be wrong I have before but I would chat with a lawyer

I own a shop and I can say- BEYOND A SHADOW of doubt- this is not the way for them to handle it.

If we found we were in possession of stolen property, and the rightful owner came forward, we would likely deliver it for free to get it back where it belonged, and assist the police and owner in nailing the thief.

Shops and dealers that do stuff like this give everyone a bad name.
