“Family say he was jogging”
Down the middle of the road and running directly at the man with a gun even after the first shot?
A jogger would have stopped or ran the other way.

So some guys unlawfully pull a gun on you and you're not supposed to react? I thought the OT was all about self-defense?
I'm confused about how you got that from what you quoted.

Horrible...the family deserves justice.

Looks like two fricking animals who need to be put down.

Supposedly they had been following him and trying to stop him for a while. It looks like he finally got pissed off and charged the guy with the shotgun instead of continuing to try and run from them.

You've never seen someone try to stop someone from shooting at them? He ran around the opposite side of the truck to avoid them. At that point if he turns his back, he gets shot in the back at that proximity.

I can't tell... did ol' baw in the back of the truck fire that first shot? He was doing something but I can't make out what it was.

What could justify the shooting in the video in OP? I'm not sure you can come up with any scenario where waiting in the middle of a street with a shotgun and then shooting someone running down the street is going to be ok
I get your point, but you asked the question: there are a few scenarios that could play out to make it justified. None that relate to this case, but there are a few. Like what if you caught some guy raping your wife or diddling your kid? I'd chase that motherfricker down and kill him.
If I saw some guy allegedly stealing copper from a build site, I'd call the cops. I wouldn't chase them down and murder them.

I am confused. Is there a video or not? Why do people allegedly feel the need to use "alleged" all the time?

A guy running from a crime has more motivation to run away, IMO.
A jogger may keep going because he doesn't know WTF these guys are doing. A burglar probably knows and has more motivation to avoid them.
More to the point, the guy clearly tries to jog around the passenger's side of the car. It's not like he makes a beeline for the dude with the shotgun.
I also don't see anything odd about a jogger being towards the middle of a residential road. It's not like he's running along a highway where cars are coming high speed.
That's a lot of gyrating to avoid the fact that rolling up on someone and pulling a shotgun on them is going to start something bad.

That would be more understandable and the jury probably gives you a lesser sentence, but it doesn’t make it lawful.

Pretty sure that's still going to catch you case

That's what I'm thinking at this point.
So with Castle Doctrine (under Kentucky law) a couple things have to happen for even law enforcement use lethal force. First, if you use lethal force you have to be able to justify it. That can only be justified if you believe your life is in danger either through serious physical injury, kidnapping, first-degree and second-degree robbery (in second you have to threaten the immediate use of force upon another person to accomplish the theft, first you have to physically injure someone in the process not involved) or other forcible felonies.
Second, even law enforcement can only use that force if the person is a "dangerous, violent subject".
And that's not even taking into consideration that your justified use of force can't happen as they're running away from where the threat occurred.
Good luck being the guy trying to argue your life was threatened when you outnumbered an (from what we can tell) unarmed guy jogging down the street while you're packing a couple of shotguns.
Yeah, that's going to be an uphill battle.
It's irrelevant if they think he was breaking in because at that point he was not attacking them nor their property and was on a public thoroughfare. They should have just let him run himself out or confronted him without firearms (since there were at least two of them to his one, three if the person taking the video was in on it).

I believe 3 things are true.
1) that dude wasnt jogging
2) those POS need to spend the rest of their lives in jail.
3) this is definitely a case that someone who wants to make an argument for racism in America should focus on...because this is definitely a case of that.

I would too, but I would still most likely go to jail for it. I do remember a case where a drunk driver hit some kids taking a family walk and killed one (or more) of them then tried to drive off, and the father who was there immediately got in his truck, ran the drunk down and killed him. He didn't go to jail
