Chickens and HOA’s Are There Any Attorneys On The Board?

So not sure if we have any lawyers in here. I could ask on the ot but you all know how that shite goes. Here is the text from my hoa
I am thinking a few backyard chickens could be considered usual pets now, they aren’t breeding if I don’t have a rooster, and if I don’t sell anything, I should be good. Obviously I’ll talk to my neighbor. We are all on .75 acre lots my half of hood backs up to nature preserve as well, so it’s not a bunch of homes stacked on each other.

I’m moving to a neighborhood that has restrictions. They’re very reasonable, so it didn’t deter me. There’s no HOA. So who would enforce these restrictions?
The restrictions for my neighborhood says no livestock, but it says nothing about chickens. So I assume they’re allowed.
ETA: In your case, it specifically says poultry. So no. No chickens.

I suppose you plan to convince the HOA your chickens aren't poultry. Good luck with that.

Chickens are a fricking mess and are typically associated with poor neighborhoods. If you have an HOA, 100% chance someone will complain. Just the way it is.

You know poultry = chickens, right?

It also says no animals in that same phrase

Well, if the bylaws of your HOA state what you quoted, I don't see anything that even remotely looks like you could get away with having chickens in your yard.
Sounds to me like you are going to spend several months fighting with your HOA and will end up looking for someone to give your chickens to after paying a few rounds of fines....

My neighborhood is 80 homes and the hoa doesn’t enforce shite. I just want to have an out if someone says something. I am thinking based off the wording of usual pets that one could now make the case as hens for “pets” so long as I don’t breed or sell them.

It also says "except for the usual pets". I'm not a lawyer, but it seems clear. You're the kind of person that makes a HOA meeting last 2 hours.

Yeah maybe in your hood but it’s not the case here. I got a friend about a half mile a way with a $5k coop and and homes that start at 800k

Correct and hens are a new common pet. Our hoa meetings usually have to be rescheduled 15 times because no one goes or sends in votes. I’ve been to one meeting. But nice assumption.

It sounds like you have your mind made up. Go for it. Fight the power.

I am the Treasurer of a sub in Ascension Parish. Ask for a variance from the board,,,no roosters to crow at daylight, pen kept for eggs, and offer fried chicken at the next board meeting.
