Not Guilty!

quote:

Louisiana Attorney General Jeff Landry’s office is not recommending prosecuting two former employees of the Department of Wildlife and Fisheries who were accused of keeping thousands of dollars of fishing and sports equipment in the wake of the 2010 BP oil spill, according to media reports. A spokeswoman for Landry on Tuesday told KATC-TV the office isn’t suggesting that Baton Rouge District Attorney Hillar Moore pursue charges against Eric Newman and Monique Savoy, who left the LDWF in 2014. “Our office thoroughly investigated this complaint and determined there is currently insufficient evidence for a successful prosecution,” Ruth Wisher said in a statement. Last June, an audit report from Legislative Auditor Daryl Purpera said auditors looking for more than $50,000 in missing fishing equipment believed they found many of the items with the couple, who have since married and own a charter fishing company in Venice. “The evidence seems to suggest that they never did anything wrong and that they were good employees of Wildlife and Fisheries,” the couple’s lawyer, Vincent Wynne, said Tuesday in the report.
quote:

The missing equipment, including rods and reels, high-end coolers, a paddle board and more, was purchased by the LDWF with funds from BP after the oil spill to supposedly perform seafood safety testing. The couple had items totaling more than $19,000 that matched descriptions of the missing equipment in their possession or offered for sale online, the audit said. The report said the workers may have violated state law in keeping the state-owned equipment for personal use, according to KATC. Wynne said the audit “was absolutely replete with falsities, misrepresentations and inaccuracies throughout.” In a written response to the earlier audit, Wynne had said there wasn’t a way to track which items may have broken or been lost during fish testing.

Pretty standard Louisiana politics. Is it really any wonder why this state is ranked 50th?

Didn't they try to or did sell some online? It would be one thing if they kept it for themselves, but how can you not prosecute someone for selling government property?

Actually the article pretty much says they are guilty but our super political AG just decided he wants them to be able to keep the stolen loot and not face any consequences.

In my opinion they should at least be required to reimburse the state for what they stole. They are using the equipment in their charter business.

If it's a state asset under 1k cash, it is insanely easy to take.

Assets under 1k aren't tracked.

For over 1k, there's a barcode, digital asset tracking system, and yearly audits.

Given the property managers of the larger agencies have bonds on them, it was likely cheaper to make them eat crow rather than the thieves.

If the assets were never tagged, it is 100% the fault of the property manager, rather than the thieves.

That auditing system isn't desogned to force arrests. Short of reporting the thefts to the local authorities, something that almost never happens, it becomes too difficult to prosecute because they can't prove who had what and when.

The charges they will likely pursue are malfeasance in office. Give it a little more time.

From what I remember when this originally came out they were selling like 6 large Shimano Stellas ($$$$$$$) NIB online. I believe some other equipment too but the Stellas stuck out.

Donate the amount plus some for a fund to take disadvantaged youth fishing.

Eh, everyone has the right to be frustrated here, but at least tax dollars didn’t buy the equipment in question. Wrong is wrong though, so a head-scratching event.

I’m sure in the end, they could not definitively prove this equipment was the lost equipment. Reasonable doubt would have made for tough prosecution.

It wouldn't have gone to trial anywhere if the items weren't serialized and recorded properly.

Too much doubt.
