Years ago I was told the measurement is while it is still rough. Finishing removes 1/4 from all sides.

I hope the judge throws this out as being frivolous and makes the plaintiffs pay the court costs and defense attorney fees.

The US started using standardized dimensioned lumber in 1924.
In the mid 1950's, I remember my father's carpenters complaining that they had to buy new T-squares and folding rulers etc to account for the dimension size instead of the old full sized lumber.

Over 50 years with current measurements (1963). Prior to that there was more variance based on wood type and locale but standard nominal dimensions were part of lumber sales since the late 1800's at least.

What are the actual damages claimed? Like someone said earlier, you don't buy lumber for the volume. Even if you didn't know the real dimensions, what are the damages?
