Why has he not been to a lawyer? It's been several months and visitation could've been arranged by now. If he "kidnaps" his daughter, chances are he'll end up with supervised visitations only. You have to act like a responsible adult and let the court system work this out. My advice would be tell your friend to grow the hell up and let this play out in court.

All of this sounds trashy. Were they married for at least 6 months? If so, I applaud their perseverance.

Just over a year. He has a lawyer. This is something that has come up. He is asking his lawyer but it seems like a shot at getting his daughter back. How is it that his wife can leave and that's okay but him getting the baby back from a friend who was babysitting is kidnapping?

If there is no custodial agreement/order filed in court then the father is well within his rights.

Also, the courts generally frown upon a parent trying to move their child 4.5 hrs away from the marital home.

Your friend MUST FILE FIRST!!! Beg or Borrow the money if necessary but file first.

Get the courts to declare him the domiciliary parent. Very important to get this declaration especially when the child becomes school aged.

He has filed legal separation and a parenting plan with him as primary custody. The wife filed divorce but papers not served. He filed after and papers to be served within the week.

This

He also needs to file a temporary restraining order that prevents her from moving a certain distance from her previous residence. In this instance the order will force her to move back until a custody agreement is in place. If she doesn't comply it won't end well for her.

My ex tried this and it make her look like an idiot.

Reverse the whip then. Have friend go to the police department and report his wife has kidnapped his infant child. Trump up tears and fears. Document this all through legal avenues.

And tell him to watch Divorce Corp on Netflix. His little scheme isn't a good tactic whatsoever.

So legally they are still married? He needs to secretly go see his child. Document everything as her not letting him see her and the wife taking the kid 4.5 hrs away. Lawyer up and try for full custody or half custody and don't let her take that child 4.5 hours away. frick her for not letting that child see her father.

lawyer guys help out on this one please:

When does a custodial petition filed in court become active? after being filed? Or after the defendant has been served?

If the wife beat him to the punch, there could be a custodial order in effect already.

Your friend might want to have his lawyer check with the clerk of court where the ex filed to see if there are any active court orders for temporary custody.

Sounds like the perfect time to go to her place of residence, plant a bunch of shite on her (weed, coke, kiddy porn, pain pills, etc.), then call the cops saying you have seen suspicious activity going on there. Sole custody coming in hot.

Looks like we got alot of good father lawyer advice in this thread. Got a court date with my ex this Tuesday. That bitch has gone out of her way to frick me it's payback time for me I hope.
