Duke and quarterback Darian Mensah have reached a settlement that formalizes his transfer from the institution, his agency Young Money APAA announced. Mensah and the Blue Devils had been in settlement talks for the last five days, and with the settlement, Duke drops its ongoing lawsuit. The expectation is that Mensah will transfer to Miami.

The schools have got to have a way to enforce these contracts. The players should not have a loophole of unenrolling and reenrolling elsewhere to game the system.

I hope more lawsuits stick and hit hard by the schools. The transfer portal is the one brutal component I want to see changed.

It was enforced via buyout.

Does Miami know that you can just recruit a QB out of HS?

That would mean their coaching staff would have to learn how to develop a QB though.

It’s wild that Kiffin was made out to be the devil for the Demond Williams fiasco but Cristobal has received basically no criticism for clearly tampering with Mensah. I’m not going to defend what Kiffin tried to do, but this is much worse. Miami waited until the last day to tamper with someone who was already under contract at another school.

For the millionth time, until they are employment contracts, these arent enforceable.

Point of academic order:
How is Mensah going to earn academic credits this semester if he is ...between universities?
Are student athletes no longer required to pass a certain number of hours to participate in sports the following semester?

Or am I remembering ancient history?

It just turns into a game of musical chairs where some school gets fricked.

If you can’t ever feel safe and comfortable with your roster, even with a player on campus and a “contract” signed, what is even the point of being a coach?

So now Duke has to tamper and steal a QB from someone, who has to tamper and steal a QB from someone, and the chain continues

not until they admit they're employees and some type of CBA is put in place

This is also week 3 of Miami classes. Is he already registered for classes? I’d imagine it’s tough to get an override to enroll this late? I am sure they will find a way

they are literally changing tax laws for these dudes, they will waive/change any “admission” requirements at the snap of a finger

Hopefully he'll be enrolled in online art appreciation by the end of the day!

what’s funny is people want them to have the restrictions of pro athletes but not the actual CBA that puts those restrictions on Pro Athletes.

Normal employees can actually leave their job whenever and almost no states will enforce a non-compete across state lines or punitive liquidation damages.

Exactly, the buyout is the only disincentive you can have in place that is enforceable until there are antitrust exemptions granted for the sport that allows a players union and schools to collectively bargain non-competes/non-solicits.

Couple things here:

Kiffin earned media ire for how he left Ole Miss. They pile on every chance they get.

I’ve said this since his staff started recruiting, they are WAY ahead of pretty much everyone else in regards to operating in the grey area without crossing the line. Look no further than his former DC, now Ole Miss’ HC, trying to use the same tactics and getting popped with tampering. Opponents, and particularly the media, wanted to catch Kiffin and LSU tampering, but they stay in bounds even if just by a hair. They have it down to a science.

Young Money APAA. Lol. Sounds like a very professional agency.

Everybody screaming for a CBA and employment contracts, why would the players organize and agree to a CBA? They're getting everything they want right now. They have complete freedom to move anywhere for the highest dollar. Why would they agree to any restrictions?

Mensah missed a big NIL opportunity. He was at a Magnolia League school and his name is Mensah.

(Miami is a top private school but they aren't generally known for it like Duke.)
