Thanks, Stout. That ends the case. ICE can arrest for impeding. The ICE agent is shielded from state prosecution because he was acting in performance of his duties as a federal officer.

Hmmmmmm....why haven't we seen this reported on by MSM???

Also one of the posts replying to Stout's find shows that the agent WAS hit by the vehicle:

So she was in the midst of committing a federal crime upon a duly deputized agent of the federal government when she got shot? Funny how that works

I saw the officer hit and then 2 shots, good shoot in my opinion.

Sad thing is if the woman would have stayed home and taken care of her children she would still be alive. Sticking her nose into business she didn't belong and those are the results, actions have consequences.

The Tousis v. Billiot case solidifies the legal view that a vehicle in motion, even at low speeds or while maneuvering to escape, can be considered a deadly weapon if it is in close proximity to an officer or bystanders.

quote:

Courts (including in Tousis v. Billiot) have consistently held that:

A vehicle can qualify as a deadly weapon under use-of-force and Fourth Amendment analysis.

Speed is not determinative; even low-speed movement can be deadly depending on context.

What matters is whether the vehicle is capable of causing serious bodily injury or death and whether officers or bystanders are in close proximity.

A vehicle being used to escape while officers are nearby can reasonably be perceived as posing a deadly threat.

Good point, but I think what you found---unequivocal evidence that Good was impeding federal officers---is even more important. It assures that the agent won't be tried by Minnesota.

We all know that the law wouldn't have really mattered in a Minneapolis court room with a Minnesota State Judge and a Minnesota prosecutor....maybe even AG, Keith Ellison.

Also, if she hadn’t given her life to Satan and turned to lesbianism, she would have found fulfillment in being a mother rather than needing to self-Medicate through social justice protests.

ICE better have moved that guy out of state with a quickness because Frey and Walz will have him arrested and turned over to the mob.
