Never take a roadside sobriety test, especially if you look drunk or high naturally

It's 50/50 that the officer will claim you're impaired even when you're stone cold sober. The reporter in the story even interviewed a former roadside sobriety test instructor, who now says that they're complete bullshite. The falsely arrested guy in the story definitely looks like an old drunk, so he never stood a chance.
If you look like an old drunk or if you look stoned even when sober, it's especially important that you never agree to a roadside sobriety test.
I back the blue, but this is some bullshite. Cops like the ones in the video are banking that they can find something in your blood test later, even after you blow 0.00 into the breathalyzer. Georgia has three different garden vareity DUI statutes that don't involve alcohol.
And for the OT-Lounge model citizens and teetotalers and Sunday school teachers thinking "SImple, don't do drugs," Lenny from the video was a model citizen, and it took him 6 months and a bunch of embarrassment and attorney fees to get this straightened out.

Yeah well if you don't like that the guy with a high school diploma can arrest you and have you charged with DUI, you can spend thousands of dollars defending yourself in a court that will side with the officer's discretion anyway. What's the problem, you little commie?

It happened to a buddy of mine. The only thing that saved him was he blew a 0.00 and also passed the drug test.
His lawyer had no interest in purusing wrongful charges against the officer for wrongful detainment.
Still had his license suspended and had to prove to the state he was not impaired.
Dude that arrested him had a MO of being that way with people.
He should have sued for that officers job and he was entitled to a comepensation from the state for being jailed over night.

I get that you need to do some kind of evaluation of people to determine someone is fit to drive (you can blow a 0.00 and be heavily medicated), but this is definitely bullshite.
You should not be able to arrest someone who blew a 0.00 period. If the cop’s subjective evaluation still raises a concern, just get the guy home safely. Throwing him in jail is ridiculous.

OP is correct, but I'd go a step farther: never agree to a field breathalyzer either. They are not accurate. Make them do a blood test or do the one at the jail.

There’s no point in doing any of that shite. If they want to arrest you, they’re going to arrest you. Which of course is totally bullshite. “The look of smell of impairment” is totally subjective and shouldn’t lead to someone having to prove their innocence and spend a night in jail and have their license suspended.

I have a relative that just got diagnosed with Bell's Palsy after we thought he had a stroke or TIA. It slurs his speech. He's scared to death to drink a beer when playing golf because he knows he wouldn't be able to explain the slurred speech to an officer if he got pulled over.

That is one of the most bullshitty elements of a DWI: when they separate the criminal charge from the administrative one.
You can potentially be completely exonerated criminally but still lose your license for a year just for not letting a cop rail road you with subjective evidence.
I never understood how that was ever allowed without some sort of baseline to compare against. So if you are clumsy you are automatically drunk?

Once they ask you if you have been drinking, the decision has been made to take you to jail. Oftentimes, this question is asked before the officer has even run a person's driver's license to see if there is an active bench warrant for their arrest or if the license is valid.
The same thing is true for the portable breathalyzer and field sobriety tests. Once they ask you do to those, it's already over. You're getting a DUI.

I’ve done it before. Passed a field test and a field breathalyzer. Blew a .06
Had been tailgating all day and went to bars after the game I was wasted. Couldn’t leave my truck at the paid parking lot overnight or it would be towed so I drove it the mile or so back to my apt at 1 am and got pulled over. How I passed it I have no idea

Funny how this is becoming a more and more common of a phrase. It's almost like the blue doesn't back you. Don't need to be some BLM ACAB person to be inherently skeptical of police, and think that they get way too much leniency in their power trips that violate our rights.

Understood, but it’s the only one that they can road-side test for.
Do we want cops arresting people because they “look like they are in drugs”? When they could simply be having a not-so-great reaction to medication (as an example)?
Like I said, if you think they are unsafe on the road, get them home. What the hell is accomplished by putting someone in this scenario in jail?

Any St. Tammany people remember this one? It was the case where the guy that got pulled over had a friend who recorded the whole interaction. That recording demonstrated the arresting officer had completely fabricated the details of the field sobriety test. Yet, initially, no criminal investigation took place...
