A Michigan Democratic effort would open up ICE agents to state prosecution if they conduct immigration enforcement operations while wearing masks that conceal their identity.
The effort comes five years after Michigan Democrats supported Gov. Gretchen Whitmer’s order outlining $500 fines for civilians who, conversely, defied her executive order to wear masks in public during the coronavirus pandemic.
State Rep. Noah Arbit, D-West Bloomfield, added his name as a co-sponsor and said in a statement when a person is unable to discern whether someone apprehending them is a government authority or not, it "shreds the rule of law."
"That is why the Trump administration and the Republican Party are the most pro-crime administration and political party that we have ever seen," Arbit said.
Attorney General Dana Nessel, who was one of several state prosecutors to demand Congress pass similar legislation at the federal level, also threw her support behind the bill.
The imbecility has gone beyond unbelievable. They're tripping over themselves to blame Trump.

They don’t give a damn about anything but hindering any policy of Trump. If he cured cancer they would come out against it. They don’t care they endanger federal agents.
It is time to arrest some of these idiot for interfering in federal investigations and harboring fugitives.

If you can see the face, you can tell if it's law enforcement or not.

Someone in the administration needs to have a stern conversation with Greedy Gretchen and her AG.

Let them try to arrest a federal agent conducting a raid/enforcing immigration law. The federal agents could in turn arrest Michigan police for "obstruction"......

EDIT: this democrat ICE hatred and trying to pass their own laws reminds me of the Southern Democrats in the 60's with segregation and trying to impose their will on Federal law and law enforcement.....that didn't go so well for Dems then and it wont go so well this time either....

Can someone explain to me how the state of Michigan has any control over federal activities being taken in their state.
Quite simply they don't have the authority over federal officers

I don't think it is enforceable under state law. ICE is a federal operation under DHS and subject to federal law, which supercedes state law. If ICE agents are allowed to mask, states can't force them to demask.

Anyone charged would have their case removed to federal court and dismissed.

It already is , I’m sure in their SOP the wearing of mask if they feel like they need to for their protection is allowed . It’s why they currently wear them now .

In the videos I've seen agents are wearing plate carriers with their agency on it. Some have had badges on them, as well.

The Supremacy Clause of the Constitution prevents the enforcement of such a law against federal law enforcement agents. There is zero chance that this would succeed.
I doubt they're stupid enough to try to enforce this. If they did, the Trump DOJ would love this slam dunk case where they could flex on the Michigan Dems and throw people in jail for this.
