Gov. Jeff Landry wins early round in Louisiana car insurance fight with Commish Tim Temple

The governor said passing the bill is so important to him that he will call legislators into a special session to consider it again if they reject the measure.

Temple, asked afterward whether he thought the governor was trying to set him up to take the blame, referred to a recent interview that Landry gave to conservative talk show radio host Moon Griffon.
“If the rates don’t go down, then it’s on him,” Landry told Griffon, referring to Temple.
Said Temple on Wednesday: “I don’t know if he really intended that. But he said it.”
Under current law, the commissioner approves rate increases that are “actuarily justified,” meaning a staffer has reviewed the data from insurance companies and found the proposed increase to be mathematically sound.
Under HB576, by Rep. Robby Carter, D-Greensburg, the commissioner could simply decide that the proposed rate increase was excessive and deny it.

Temple said that is already happening for property owners after the Legislature passed a slew of insurance measures affecting them last year. Eight insurers have filed for lower rates this year, he said.

Increase liability limits across all providers, actually punish drivers that drive without insurance/no license, reduce pain & suffering payouts.

Landry's shifting blame to the insurance commissioner instead of actually working towards the root cause. This is so that going forward he can just finger point and say that it's the commissioner's fault.

I can't figure out if either of these guys is a good guy. But it's pretty clear from the article that a bill that gives the Insurance Commish the mere power to refuse a requested premium rate increase won't actually change anything.

How are the people so ignorant as to not see that Plaintiff Attorneys, Judges, Public Adjusters (for property) are your enemies? Runaway verdicts nationwide are the issue. Dont support the billboarders and elect better judges, and hope for better juries. Your rates will come down. Cut off allowing Plaintiff Attorneys to sponsor colleges and sports teams, it is a cancer.

Tim Temple may be one of the few honest people in state government. What an extraordinarily bad piece of legislation this is from Landry.

California tried this. This is why the people in LA did not have homeowners insurance. All the insurance companies fled after the state failed to allow them to increase rates. The same thing will happen here.

The bill doesn't define what "excessive" means, so it's useless even if it were to pass.
The governor is hyping this up because he wants to distract from why rates are actually high (e.g. the trial lawyers to whom he promised to deny tort reform in exchange for their support during the election.)
Louisiana's biggest problem in the insurance market is not letting the free market rule. Insurers don't need Louisiana to exist, but Louisiana needs insurers to survive.
