They can’t comment into “ongoing investigations”. Or any prior investigation…. Unless they leak or lie to congress or take classified materials themselves or set process traps or leak to the press like a sieve or issue false memos to the media to protect politicians they favor or try to justify refusal to prosecute actual crimes.

He GETS the evidence, and he can use it to defend himself in court. He just cannot start trying the case in the media and poisoning the jury pool.

Yes.

Also, ignoring the various "Police state" issues involved in this discussion, a major artery of discussion SHOULD be on the bullshite classified status and how easy it is. It's usually used to protect inept governmental officials or frickups so we can't see.

I have no issue with that. I think people just don’t trust the feds to do the same. To not to leak and spin narratives in the media to taint this case. Do you?

A decent judge would deny their request since the government intentionally leaks these sorts of details on their own. But, our judiciary is broken.

It's stunning that the judiciary is so spineless.

It appears nearly every government document is classified. Tucker reported there are currently 1 billion government documents labeled as classified.

This ^^^^ is how the Bureaucratic State controls government documents if the need arises to begin a cleanup operation.

I wonder what the DOJs response would be if Trumps team asks what the penalty will be when the media drops "per anonymous sauces" tidbits.

Or will he not be able to respond to anything that "hits" the news cycle via sauces?

No doubt will be tried, but as long as the judge is stern and says "no" then it really can only cause more delays.

They need the trial to start/end in the Trump nominee summer/fall 24 window or really won't matter. He'll either be President to pardon himself or loses and no longer a threat, so they'll want to save face to try to say in the future that political persecution isnt good for "mUh democracy".

This really is going to be tough to get in the window they want so they can't afford adding more time.

All IMO of course....
