Maybe. I’d have to see how Louisiana has handled the exception in criminal trials.

I dont recall ....odd how? Since we are going there, as it was mentioned, anal sex is messy even under the "right" circumstances. I wonder if they were able to determine that the anal sex took place within hours of her death.

"Previous" I guess that could be seen as an odd adjective to insert and interpreted as the injury had healed or was in the process of healing... IE she had anal sex before the night in question?

Yeah. The word “assault” undercuts that view though.
I think it’s just an odd word choice. Or maybe it’s the way doctors describe it. I dunno.

if the pathologist's statement referred to an act that was unrelated to the current charges, it would have been incredibly stupid to include it in the warrant/affidavit...

Agreed - poorly thought out take about faculties at that BAC based on my own personal experience. It doesn't change the fact that .319 is an extremely high BAC though under any circumstances. You may in fact have some of your faculties, but you're not likely going to remember a thing the next day.

The interview lasted about an hour, I believe. The affidavit contains salient information for an arrest warrant. Much more was discussed in the interview that wasn't included in the affidavit, presumably in the interest of brevity and conciseness.
Madi wasn't talking after 2:50a on the 15th. She was already brain dead or removed from life support.

Well, one couldn't find her way to an address, apparently didn't know she didn't have her phone while informing the others she'd call an Uber in freezing cold temps, and then wandered in front of a vehicle.

It was oddly worded but since it said 'assault' I thought it meant from that night.
