The victim wasn’t just “legally drunk”. She was incapacitated and unable to consent. The very definition of rape. Read the affidavit. She was unable to speak, slurring words, and couldn’t stand.

By the letter of the law, yes. Whether it should be or not is another discussion, and it is a valid one. This thread and this case are probably not the best places to have that discussion because it's pretty obvious that is not what happened here.

Video showed her stumbling and the three people had to help her off of the ground.
Casen Carver stated she was "drunk", unable to keep her balance, and couldn't speak without slurring her words. She couldn't answer him where her home was located. He also stated the 17 year old asked her 5 times to have sex. After he was done, Washington got in the back and asked her multiple times to have sex and then they did as well. Eventually he says "we got to stop this" and told his friend to stop having sex with her. All of this adds up to she didn't know what she was doing.
Washington then gives his statement (and lies about having sex with her and refuses to give DNA). He had to tell her she was pulling on the wrong vehicle door. He said she was "drunk, drunk". He denied seeing anyone have sex with her.
Washington is the one that claimed they dropped her off in the neighborhood, and he's proved to be the liar of the group--for all you idiots believing that part of his story.
