Two working extra duty and to actually at work. Three do noting and one runs to his car and leaves while people are shot. The local media is silent. Where are the GPS and body cams? It’s a complete coverup. I hope they are sued by everyone there. The city will settle.

We now know the full story.

Move along. Nothing to see here.

Yea, the concept of police is failing everywhere, Scruffy agrees, but you need to realize that, legally, the police are not obligated to respond to anything.

It looks bad, but it has been ruled by the US Supreme Court that police officers, essentially, do not have to help you.

Are you saying 2 were on the BRPD clock and were just hanging out with the 2 that were hired by the venue ? .. And then only 1 intervened and no one was arrested ?

The Supreme Court ruled on Monday that the police did not have a constitutional duty to protect a person from harm, even a woman who had obtained a court-issued protective order against a violent husband making an arrest mandatory for a violation.

That is from 2005. There are other cases.

Considering that people who willingly go to that club and are still hanging out there during that time of night, that’s pretty much an expressed disinterest in surviving. Why should cops get in the way?

They can be fired, but it is highly doubtful that any lawsuit would proceed.

Or, if it was appealed, the courts have already ruled on similar situations.

They have the legal ability to act, but they aren’t legally obligated to.

Maybe Nak can leave the small town mayors alone and get on the scent of some body cams.

Makes me wonder how the shooter got away and why one cop left. Maybe the missing cop was the shooter’s ride.

Nak real reporting is no longer. He's bought and paid for. UWK is the only one I really follow anymore.

Well, had they fired and killed the perp, they would be fired, out of a job, and on trial for murder, so I can see why they didn’t get involved.

§134. Malfeasance in office

quote:

A. Malfeasance in office is committed when any public officer or public employee shall:

(1) Intentionally refuse or fail to perform any duty lawfully required of him, as such officer or employee; or

(2) Intentionally perform any such duty in an unlawful manner; or

(3) Knowingly permit any other public officer or public employee, under his authority, to intentionally refuse or fail to perform any duty lawfully required of him, or to perform any such duty in an unlawful manner; or

(4) Willfully and knowingly subject any person to the deprivation of any right, privilege, or immunity secured or protected by the United States Constitution and laws, if serious bodily injury or death results.

What duty was lawfully required?
