ROFL .. this has happened before. When it went to court .. the other half was awarded everything.

Pretty sure this stupid shite has happened before and the spouse that was dumped was awarded the entire winnings...

It's not like there is a date of sale anywhere on the ticket...

Lol, good luck.
Winning numbers were drawn when you were still married.

Seems like they would say the assets were acquired at the time of the drawing, but who knows.

Community property when the asset is purchased. Better plan is to secretly give it to someone to cash for you and put the proceeds in an offshore unmarked account.

We talking 10k or 10MM?
If the latter, you could find a professional to kill your wife if you hate her that much.

you claim the winning ticket after the divorce is finalized to avoid having to lose half of it to your ex? Seems like most states give you about six months to claim a winning ticket.
There was a case years ago where a woman left her husband without any warning. She divorced him and it was finalized in the court. A year or so later the state lottery sent a letter to their old address with a survey of past winners. Dude did some research and found out she won 1.5 million state lotto.
Long story short he took her to court. Judge gave him his half and half of her half as a penalty for not disclosing.

In community property states where the ticket is purchased with community funds (generally, all funds are presume to be community funds), the winning ticket itself is an asset of the community. Therefore, if you don’t tell your spouse about it prior to the divorce, then you fraudulently withheld an asset and can be sanctioned for that.
So, your short answer is the spouse is going to get half.

Give the ticket to me and I’ll give you 60%.

And in that case, not just half but I imagine a penalty for not disclosing so you'll inevitably lose most of it.

No. Someone tried once and it did not go well for them.
