We have a mitigation clause. We can waive it if he agrees to take less money on the way out.

It's also paid out monthly, many, maybe most of these negotiations revolve around a quicker payout. So we owe you 53 million over the next 6 years. How about we pay you 30 next 2.

Maybe the Greg brooks thing factors in?

NOT A DEFENSE OF KELLY

But what did he do wrong regarding Brooks?

The kid had a very unfortunate and rare cancer diagnosis. BK is a coach not a doctor. WTF was he supposed do different?

My understanding is that the time from symptoms to diagnosis in Brooks was a lot shorter than the average person diagnosed with that cancer.

I’m Kelly I’m making you fire me for the full buyout. I will continue to trot Nuss out there and endure the chants. Humiliate the fan base, AD, and the university until you pay me the remaining balance. It’s too much money to walk away from. BK is the right kind of POS to force it.

There is a good chance he still has some pride and probably didnt think the buyout was even necessary other than if the admin lost their minds. Les Miles negotiated the buyout, he may want to go out on good terms and not have his legacy tarnished.

Learn about the time value of money, then read Kelly’ contract. He’s paid month by month and has to mitigate. Sometimes a lump sum is better.

Expecting someone to honor a written contract is not being a POS.

I'm no Kelly apologist but that is why there is a contract.

Right, but the contract has myriad clauses and conditions and terms. So any competent lawyer will review the contract and make arguments that Kelly has violated its terns, or that his damages are capped by its terms, or that they have to be offset by mitigation, or that the contract was entered into based on fraudulent misrepresentations, or any number of other impediments. Then the lawyer will threaten to embroil Kelly in years of protracted discovery and trial and appeals before he sees a cent. All of that, combined with the prospect of an exhausting public ordeal that further tarnishes BK's reputation, creates leverage for some type of a settlement, either reduced payment or extended timing or other relief. Thats just how this works. When there are tens on millions at stake, its highly unusual for one party to simply acquiesce to payment.

Bro. No coach wants that humiliation. Say what you want but sometimes your nuts are worth more than reasonable money. If he drags it out then he looks like a complete pussy and other coaches wont take him serious. Be a man and take a little less to walk out with less stink. If he does that he can snipe at LSU and blame them

I don't think any of this is happening. This is some Law & Order TV wet dream.

University wants a lump sum for less overall exposure. BK likely wants a lump sum so he can do whatever he wants going forward without incurring a loss.

Because he doesn’t want to give a deposition about real estate “commissions.”

I think it should be fairly obvious that Kelly has to do this for 6 more years to earn his full buyout. He is maybe already fired before the end of 4. I think it’s reasonable to negotiate

Morales clause could be in play.

You get zip. And here is what we got.

Or let’s …

We can do this the easy way or the hard way.

Only thing that makes sense

Lol. Okay. It's literally how any major contractual separation occurs. The ignorance of this board is staggering at times. Do you really believe that when sixty million dollars are at stake they dont get the lawyers involved to make arguments under the contract terms about why the payout/damages should be reduced? It's part of the leverage for the negotiations. But believe what you will.

I don’t think he has anyone supporting him. Not the fans, not the administration. Not former players; I haven’t seen that his current players have his back, either. I watched an interview earlier on the Matt Barrie Show where Finebaum said BK’s hated by the national media. I wasn’t aware of that, but I’m not surprised.

He completely lost me when he snapped at Cauble.

Our top donor is a trial lawyer. If he wanted to nail BK on Brooks he could.

The dude is not a great coach and has not produced results and it's time for both parties to move on, that doesn't make it an episode of Matlock.
