Or they just flag all the IMEIs not sold through their stores, like BestBuy.

OP said they wouldn't even look it up to see without a receipt.

EBay is the largest purveyor of stolen /shoplifted goods in the world.
Just sayin.

Yea, the guy offered a refund so we'll see. Just shipping it back. Sucks though.

Well, it's the largest facilitator of second-hand sales, so it kind of goes with the territory. But I'm surprised that eBay allows people to sell iCloud locked phones. They might as well list its condition as "stolen."
I still don't understand why AT&T is being shitty if the phone is confirmed to have a clean IMEI (easily verifiable on swappa, so OP needs to do that immediately). Otherwise, I would just do as Blue suggested and ask them for a nano SIM.

ebay could easily implement a swappa-like IMEI check for cellphone sales but whatever. swappa is a billion times better for purchasing phones.

Or go to ATT and say you lost your sim, can I have a nano sim?
I don't even know what this means. Please, educate me.

AT&T has gone into full scam mode. Anyway they can force you to spend with them! I predict a major lawsuit in the next few years.

I'm thinking it was reported stolen or something. Why people continue to get in bed with Apple and lose control of their devices amazes me.
I'd call back and try another agent. If no luck, asked to be transferred.
You legally bought a device and can prove it thru eBay receipt and who you bought it from.
You won't have luck with a BB receipt, IMO. Why would you still have a sealed phone, never opened, and be selling it?
Who cares if it were stolen, tell em to send the pokice and you'll prove purchase.
Again, screw Apple

Some people prefer the UI of Apple and don't care to have complete control over every level of the device. It's not that difficult to understand. If you don't like it, don't ever purchase one of their products.
I had a 2nd generation iPod back in middle school and have been hooked ever since. I've had 3 iPhones, 2 macbooks, and an iPad (from work) since then. All have been great.

Is it unlocked? Could you just activate through Straight Talk's Bring Your Own Phone program?

Have you asked the eBay seller for a copy? If it's new in box they shouldn't have much trouble providing it.

Put it this way, it was a phone whose IMEI is associated with a BestBuy lot, but the phone was never scanned out at BestBuy. It doesn't show up as stolen on the IMEI searches, but ATT has black listed them since they've made them into the public without being scanned out at BestBuy. The eBay seller was BUMMED to hear, I'm sure he was convinced they were clean when he purchased them.
He called me and made it right, he's hoping the prepaid SIM cards work in it. I just sent it back today.
