Xi Biden rescinds Trump gig-worker rule
The Labor Department on Wednesday announced the withdrawal of the Trump-era independent contractor rule that allowed businesses to classify workers as independent contractors as opposed to employees on Wednesday.

The administration’s move, effective Thursday, allows for workers considered ‘gig workers’ to have minimum wage and overtime compensation protections under the Fair Labor Standards Act (FLSA). Employee classification has major implications for companies like Uber, Lyft, and DoorDash, which depend on gig workers.

Walsh last week said that “in a lot of cases” gig workers should be full employees rather than independent contractors, which marked the first time he had weighed in on the debate over the classification of these workers.

"We are looking at it but in a lot of cases gig workers should be classified as employees," Walsh said in an interview with Reuters.

A spokesperson for the Labor Department confirmed his comments and elaborated by saying: “The Secretary was reiterating that misclassification is a pervasive issue that impacts both the economy and workers. Worker protections under federal law create a safety net of security and benefits that provide ladders of opportunity into the middle class. This safety net should be further strengthened.” LINK

I haven't used an uber in maybe over a year. Don't really see the need to anytime soon either.

Demand for them has to be pretty low compared to what they had pre covid and now you're going to raise the cost of their service?

Yikes.

ETA: the whole point of gig work is the flexibility tradeoff for the stability of a full time job. You can't make every job a robust full time deal with full benefits. It literally advertises itself as a side hustle.

This is a double whammy of fricking over the low income drivers and the company at the same time. They won't be able to take advantage of tax laws anymore. Typically these drivers make $9,999/max for each service and the government has no ability to tax them because they are recognized as payment processors by the IRS.

These companies were always doomed to fail because you can't scale them but this is going to cause big problems for them on top of that.

The goal is to protect legacy industries that are far more likely to have entrenched unionization.

Gig economy workers-ride share, food delivery, etc-are useless to worker Unions. They make less than a typical hourly employee. So instead of adapting or changing with the times, the Unions are using their political leaders and their influence to choke off innovation and market disruption to their methods of continued power and influence in the marketplace.

It’s funny, but liberal ideaology is such that they used to protect the worker. But now they are only interested in protecting the monolithic, conservative, outdated and outmoded institutions of the past that aren’t reflective of a modern economy.

They will destroy innovation and market disruption worse than anything a conservative free market type ever thought of in order to protect an institution that supports its worldview.

This. I can’t be forced to wear a mask in my own car driving an Uber and then have them claim I’m an “independent contractor”

Bull shite. I have a side job of providing security at a local church. I'm an independent contractor and get a 10-99 every year. Still had to wear a mask inside the church.

Uber and Lyft drivers don't make scratch to begin with after they deduct their miles driven. Now that they're W2 employees, they can't deduct their mileage. So now, they pay taxes on the money they bring in, but can't take a deduction for what it cost to generate their income.

This doesn't sound very worker friendly. It appears the Dims want it both ways. Take from the means of production and then take from the working class. Where have I seen this before in history?

that’s the church’s rule though

My rule in my own car for everybody was that no masks are required. Uber tried to dictate how I did my job beyond the “point A to point B” part.
