I have written this in three other threads and it is a very simple fact of Congress would just pass a law declaring everyone entering the US illegally (not those who entered legally and then had their status changed) or declared enemy combatant
That solves a whole range of issues including the courts and also takes care of the birthright citizenship because thr children born of enemy combatant.
