This goes after Universities as well.
Trump’s new anti-DEI executive order requires the Attorney General and the Secretary of Education to provide guidance to universities on complying with the Supreme Court’s affirmative action decision:
“Sec. 5. Other Actions. Within 120 days of this order, the Attorney General and the Secretary of Education shall jointly issue guidance to all State and local educational agencies that receive Federal funds, as well as all institutions of higher education that receive Federal grants or participate in the Federal student loan assistance program under Title IV of the Higher Education Act, 20 U.S.C. 1070 et seq., regarding the measures and practices required to comply with Students for Fair Admissions, Inc. v. President and Fellows of Harvard College, 600 U.S. 181 (2023).”

This was released late for a reason. This is one of the Sacred Cows. There will be fierce backlash. Would not have believed it without reading the executive order myself. None of this feels real.

It is required on highway jobs that a percentage of contractors be minorities. Usually a minority company is awarded to check this block knowing one of the other companies will need to pick up the slack.

Every September, my account managers would get calls from government agencies saying, "I have budget dollars to spend but I need an 8(a) contractor."
So, we had a list of 8(a) contractors we'd put them in touch with. We'd give them our standard, non-discount, and very profitable price, and then the 8(a) contractor would typically add 50%+ for handling the paperwork. They'd get the order, then they would contract with us, and everyone made money.
It's a fricked up system that cost the taxpayers an awful lot of extra costs over what it should be.
* For those that don't know, an 8(a)contractor is a small business that has been certified by the Small Business Administration (SBA) to compete for federal contracts. This helps socially and economically disadvantaged businesses (women owned, minority owned, disabled owned, veteran owned, disabled veteran owned, native American, etc.. to gain access to government contracts.
While I applaud the elimination of affirmative action, and while I agree this will save the taxpayers tax dollars, it is going to have serious ramifications on small businesses.

please elaborate. i know two 8A contractors - one majority-minority owned and one women-owned. both talked about at some point soon they would be "graduated" from this certification. what do you predict occurring?

Most of us old timers have similar episodes of uncertainty and failure to express reservations about 'what could happen' with partiality being a required element, rather than an outlawed element, in job assignments and promotions.
I didn't speak out either. But at that time the overall sentiment was that "this could actually work out great for everyone" and stymied the thoughts of 'what could go wrong'
And then we watched the thing slowly - and purposefully 'go wrong' - and have had to live with our 'what ifs' ever since.
I'm out of the rat race now, and still wish someone had demanded a bit more training wheels attached to that first declaration.

This happens more than anyone thinks. We could probably save a trillion dollars while providing the same services just by working with the subcontractors directly rather than via a minority middle man.
