Sept 28 (Reuters) - Lawyers for former President Donald Trump are resisting a federal judge's instruction to submit a sworn declaration on whether they believe the government's list of property taken from Trump's Florida estate is accurate.
According to a letter publicly filed by Trump's lawyers on Wednesday, the former president's legal team told Senior U.S. Judge Raymond Dearie, who is reviewing the materials taken in the federal raid of the Florida property, that they don't believe Dearie has the authority to require them to make such a filing.
The former president has repeatedly claimed without evidence that the FBI planted evidence.
The Trump lawyers' letter, dated Sept. 25, says the order by another federal judge appointing Dearie to conduct the outside review of the materials only requires that the government file a declaration on the accuracy of the inventory list, and not Trump.
Trump's lawyers also said they could not verify the accuracy of the property list because they do not currently have access to information taken in the raid that was marked as classified.

How can you verify a list of property seized when you weren't there when it was seized and have not been given access to see what was (or was not) allegedly taken?
It's not like we don't ALREADY KNOW the feds took numerous personal items and other material far outside the scope of the warrant...

I wouldnt "verify" any of their garbage for them. They just want to get Trump to step in it here by indirectly killing claims that they seized other items not on the list, which they have alleged.

I thought most of these boxes originated by being packed up by the GSA when Trump left office?
Is the onus on Trump and his staff to then inventory said material?
This is a witch hunt and they are going to "find" what they want to whether it was there to begin with or not.
If the goal is to try to prevent Trump from running for office in 2024 that is not going to go well.

The government provides you a list of items they took and you're verifying that's what they took.
It's not as onerous as you're making it out to be.

so they can't verify the list because there are allegations of other items that were seized. if they do this for the DOJ, they could undercut their ability to litigate that.

What’s the legal consequence of something else turning up after you verify the government’s list?
I bet if we looked hard enough, we find somewhere in the government past an incident where at the last minute they produced new evidence or records in some case somewhere.
