Will the DOJ produce the recording for the defense?
And yes, the way the DOJ lays out the indictment, if all true Trump is screwed.
Do you believe all of the indictment is true or do you believe the DOJ possibly embellished it to their side?

He...and they...are so fricking stupid that they think he still has the authority to declassify documents when he's been a private citizen for almost two weeks.

Imo I believe you have to give the benefit of the doubt to any President and former President when it comes to whether or not material is classified. The law clearly gives the President the authority to declassify anything for any reason, however he chooses to do it. You can’t make the argument he didn’t declassify it when classification is completely within his discretion. The problem with this indictment is that it’s trying to create a standard of presidential declassification where none legally exists. Like the standard of presumption of innocent until proven guilty, you have to have the presumption that any document in possession of a President or former president is declassified when in his possession unless you can prove that he broke into the archive and stole it after his presidency or was part of a conspiracy to unlawfully obtain the document

Biden could do that with National Security documents, and once they are requested back, Trump is required to return them in a timely manner.

Well, that would be a novel defense to claim that an Iran War plan drawn up for the joint chiefs after the end of Crossfire Hurricane somehow is about Crossfire Hurricane, but like I said, Trump will get a chance to tell his side of it.

Because Bill Clinton was found to have had classified material in his sock drawer … the judge in that case ruled that the president was the declassifier in chief and could do so in any manner he so desired . No one has ever disputed this ruling therefore it is PRECEDENT .
