I suspect that this will all depend on finding out whether Biden was even aware of who was being pardoned and who was actually signing them with the autopen.

Biden publicly talked about his pardons. I personally felt he was 100% in the wrong to issue those pardons, but there can be no doubt he was aware of them.

Yep. It's a longshot but a longshot beats a no-shot.


Seems odd that auto-correct hyphenated no-shot but not longshot. Seems like it should be both or neither.

There wasn’t time for the 25th Amendment to be invoked. He pardoned his family members minutes before leaving office. He issued the presumptive pardons just hours before leaving office. In order for autopen to be valid the person’s whose signature was signed has to be aware of and intending to sign the document. If Biden was not aware his staff was using the autopen then it would not matter if he had capacity or not.

I imagine they know who worked for Biden and could get them to testify if they had knowledge of approving or adding to pardon list without Biden having knowledge. Get them on record, under penalty of perjury. May not need Biden at all.

I know what you are saying.

However, you are going to have to get proof he was incompetent. Good luck. He won't testify (if he can). His people won't either. The Doc probably certified he was. You're a smart guy. Play this out in your head. How do you prove he was short of video evidence showing specific actions signed by other people.

Not sure exactly sure, but what I do understand is that the President needs to have a clear understanding of whom he is pardoning is the idea behind it.
