Trump admin may have outsmarted the judge in the pro Hamas activist Mahmoud Khalil case

Here's where things get interesting, though, because it appears the Trump administration may have outfoxed the judge in this case. According to reports, Khalil was moved to an ICE detention center in Louisiana. Why is that important? Because while Furman issued his order based on Khalil's New York petition for habeas corpus (i.e., that he be released pending further litigation), the law requires that the petition be filed in the federal court district the subject is being held in. If Khalil isn't in New York anymore, and it seems fairly certain he isn't, then Furman has no jurisdiction over the case.

It sure seems like the Trump administration just did an end-around a Barack Obama-appointed judge. Whether Furman will acknowledge that is another question. He may try some other administrative gambit to remain involved in the case, though as a non-lawyer, I'm not sure what that would be. For now, though, it seems Khalil's deportation is very much back on the table.

Glad Louisiana could help.

Is this the college student they arrested who is on visa but married an American or another case? Either way glad that piece of garbage is being removed. Hopefully we can send his wife with him. We know how much the left hates separating families and all.

There's places in the swamps he'd never be found

Either way, supporting a terrorist group should bring criminal charges anyway. So either deport or go to prison.

I didn't say he was. Reread the post I was replying to

I thought it was weird he was being held in Louisiana, but this explains it… lol, glad to see Republicans actually fighting

on the other hand this is a terrifying precedent to set.

Meh. We have been living under an attempted coup by the judiciary for a long time now where they attempt to appropriate all power to themselves.
Until that is ended I don’t give a frick about the precedent

Even if the Judge tries to butt in and say "no", put the fricker on a plane anyway. The judge can't order his return, and what could he do to those involved? Trump would get them out of whatever trouble he MIGHT be able to get them in.

So this guy was born Palestine but raised in Syria.
Came on student visa in 2022, got married less than a year later and got his green card in 2024.
This is prob like Omar marrying her brother. They got a system to get people legal status.

No, tell them to file the writ in the proper court.

Go frick yourself Hank. We all know you’re a pretend larper who’s a pretend lawyer. SFP may be annoying and at times even disgusting but he is at least very intellectual and I believe an actual lawyer like he claims to be.
We all know you’re lying. Idk why you insist on keeping this lie going by replying to everything you can with some sort of faux lawyer lense to your posts

Same scum bag judge that ruled that the Trump administration violated APA by adding citizenship questions to the census.

Of course we do have our share of crappy Obama/Biden/Clinton appointed judges that still gum up cases. One of them is even a Dick by her name.
But at least there is the 5th circuit appellate court that is still pretty stacked with Bush/Trump Apointees.
