It is not murder if it is decided that the shooting was in self-defense.

Has the State of Texas charged the shooter yet? This incident happened years ago now.

State of Texas says it's a justified homocide. Refuses to press any charges.

Nevermind. Can't believe he wasn't charged.

New boyfriend life was NEVER in trouble,

Looks like he was in trouble when the guy said he'd take the gun and then attempted to do just that. Don't want to get shot? Don't trespass and attempt to take the homeowner's gun by force.

Who learned the hard way again?

This was premeditated murder. The Castle Doctrine won’t apply in this case.

Look at all these legal scholars wrong in this thread

It's funny to read this thread looking back now that no charges are being filed

A lot of wishcasters condemning a man for using a gun within his rights on his property and hoping he gets charged.

All of you that wanted this man charged have absolutely no idea about self-defense situations. Hopefully, none of you ever have to defend your home because you all would be screwed worrying about when it's OK to brandish a weapon or not.

The ex husband made no attempt to enter the house. Brandishing the gun is assault that led to the death. You can't shoot someone for trespassing.

What you have are a bunch of commies that want to chip away at your right to self defense. They are salivating to have a case like this ruled against the victim. They want to establish that you can't use a firearm to defend your own home. They want it to be illegal to shoot someone who says they will take your weapon from you and then act on that threat. Their ultimate goal is for you to be completely legally unable to defend yourself.

Thank God for Texas.

The fatal shot was fired from 8 feet away. The guy is toast.

This guy never heard of the 21 foot rule cops use

quote:

Another factor to consider in a potential self-defense situation relates to the “21-Foot Rule.” This “rule” was developed as a guideline from research conducted by Dennis Tueller, a Salt Lake City police department instructor. According to his research, a person charging toward you with a knife or other sharp-edged instrument can travel 21 feet in the time it would take you to recognize that there is a threat, draw your firearm, and fire two shots.

He didn't have a knife but just FYI the 21 foot rule is what many states that have "stand your ground laws" base them upon

She should have given him his child. She's a bitch, and her boyfriend was helping her to hide the child.

No, YOU missed the point which was, that happened AFTER he went inside and got the gun. The point being made (I have no idea if true or not) is that if he produced a gun BEFORE any threatening action then he can be said to have escalated and caused the violence.

She was 100% being a bitch but that's when he should have called the cops to enforce the legal order to see his kids.

Taking actions into his own hands on someone else's property is never going to end well. Even if he wasn't shot he could have ended up in jail for trespassing.

Libs are always wrong about everything.
The only way they "win" is to stack the courts with activist judges and cheat.

With just a few exceptions, almost every instance of one of these “rednecks” or “racist white cops” or “white hispanics” using deadly force the outcome has been that the “redneck/cop/white hispanic” was well within his rights to use deadly force.

You anti self-defense Commies have been consistently wrong about these self-defense cases over multiple years.

The guy with the gun is a pussy, but he had a right, under TX law to brandish & use the firearm if he was threatened on his own property.

Someone comes on my property, with bad intentions, if they don't have a weapon, I'm gonna whip their arse, because I'm not a pussy.

No doubt

The victim took matters into his own hands instead of calling LEO for assistance to enforce a ruling. He really messed up when he did it on the boyfriend's property.

The wife is a bitch for withholding the kids as she did but he was an idiot for trespassing, not leaving when told, and then assaulting the guy and trying to grab the gun.

No winners in this situation but the law was used and applied correctly. Anything less than that as the standard puts us all in danger if we ever have to defend our homes.

I can brandish a weapon on my property especially if I fear for my safety and for the safety of my family. I can use that weapon if I am assaulted and fear for my life or the lives of my loved ones.
