It’s pretty remarkable to me that the president can kill foreigners via the military on his command but if you are here illegally and a threat to Americans at home you get all this due process.

Where does it say in the opinion that the AEA is being “misused”? That wasn’t even the issue before the Court. The Court specifically states it is not reaching the merits of whether the AEA is being properly applied.

Its not that easy for poor folks that have few or no other ties to the US. Why do you think some of these folks would make such a treacherous journey if there was an easier and safer way?

Thanks for posting. You're right. The chief issue was what is adequate notice of deportation.

This.

The sole issue was whether the 24 hour notice given (with no information on how to respond to the notice) was sufficient. They concluded it wasn't and remanded to the 5th Circuit to render a decision on what constitutes sufficient notice.

That's all that was decided - hence, Kavanaugh's concurrence .

Rebellion? Inapplicable (like the "declared war" clause in the AEA)

Invasion? Just as speculative as with the AEA.
