Of course he also had the right to shoot to defend himself when the other guy shot first.

No way should or will charges be filed.

Separate and distinct from the world in which our nation’s increasingly militarized Police State is thought to be preferable to citizens asserting their natural rights to arm and protect themselves from criminal acts.

I was referring to the dead man’s Brother and female accomplice. Whatever we tolerate we get more of. That is a fact. If the Law don’t defend honest folk then vigilante justice should, must and will.

While the outcome here seems acceptable to me, there ARE potential problems (if law enforcement wants to give this guy problems).

First, Texas law entitles him to use force (pulling the gun) to recover his property only if he is in "fresh pursuit." The fact that he found the truck at the same mall where he was eating is certainly evidence of "fresh pursuit," but it does not seem that he saw the theft and pursued the thief immediately. He found the truck by other means (GPS?). Arguably, that is not "fresh pursuit," depriving him of a statutory right to use the gun to detain the thief.

If he had no legal right to use the gun, his dominoes begin to fall. The unauthorized use of the firearm would arguably make him the "initial aggressor" in the confrontation with the decedent, negating a statutory right to rely upon "self defense." In fact, law enforcement COULD argue (along with the brother) that it was the thief who was exercising "self defense" because the truck owner had engaged in an unlawful use of force.

Again, I don't think that will happen (or that it should happen), but all of it is a possibility, if law enforcement decides to make his life miserable.

Why not? You take someone's vehicle, you easily can be taking their livelihood, how they feed their kids, get to the doctor, etc. You should expect deadly force when you seize the property of others, particularly major property.

Yep, you will either have to trust the State to protect you, or you have to protect yourself.

I have no faith in the State.

Taking someone's property is stealing the hours away from their family to work to earn the funds to pay for that property. They can never get that back.

Yes, it is worth taking someone's life. The question they should ask themselves is "Is this property that im stealing worth losing my life?".
