They certainly do not own airspace 10 feet above my yard

In fact in the past was the law that you owned up to the sky

Yes under normal circumstances you get up to 400 feet.
However, a TFR specifies from the Surface up to 1000 feet here. It was put in place just so Fox could not fly their drone. Purely political.
